Acceptance of Terms, Conditions and Disclaimers

Thank you for visiting www.espapparel.com.au The Website is owned and operated by Esp Apparel Pty Ltd.

By accessing or using this Website, you agree to the terms and conditions (“Terms & Conditions”) and acknowledge and accept the disclaimers and that you have read and understood these Terms and Conditions.

By purchasing a product or service from this Website and/or by completing the order process, you expressly agree to be bound by these Terms and Conditions.

Esp Apparel may amend these Terms and Conditions from time to time. Any amendment will be effective immediately upon being published on this Website. Your continued use (via browsing and purchasing product) on this Website after any amendment becomes effective constitutes an agreement by you to abide and be bound by these Terms and Conditions, as so amended.

 

Production Time

ESP Apparel will endeavour to complete your order within a 2-4 working week time frame from date of customer deposit payment.

Circumstance for non delivery within this time may be due to the following and are not accepted as reason for cancellation by the customer:

1.             Goods being unavailable from supplier by due date

2.             Customer changes to artwork/embroidery digitising

3.             Freight delays

Urgent Orders

We are happy to accommodate urgent orders if ESP production schedule allows, however extraordinary expenses will be passed on. A surcharge may apply.

Cancellation of Orders

Cancellation of orders by customer will incur fees for Artwork/Embroidery Digitising already processed and or supplier charges for return of goods.

Changes to Orders

Once an order had been processed via our website changes to garments cannot be made to colours, sizes, or quantity unless additional items are added to the existing order.

New Artwork/Digitising

Screen-printing – artwork will be provided to the customer for approval either via Email, Fax or in our showroom in person.

Embroidery – an embroidery sample will be stitched on fabric and will be provided to the customer for approval via Email for approval or in our showroom in person. Re-sampling in different colours to that which is originally specified will incur costs.

Changes to artwork/Digitising will incur costs if specifications differ from original requests.

Once the approval form has been signed by the customer, changes can no longer be made to artwork for the current order which it relates to.

Repeat Artwork

Unless clearly specified at the time of order, all embroidery & screen-printing artwork previously approved is considered to be approved for current orders.

Artwork/Film/Disc Property

All film separations remain the property of ESP Apparel. A nominal charge towards the film separations has been applied for the exclusive use thereof. If at any time ownership/copy of the film work is required then the balance will be calculated at the industry standard of $20 per colour over and above the current invoiced amount.

All physical screens used remain the property of ESP Apparel and have not been invoiced as part of the set-up for screen-printing and are not for sale at any time.

Screen-printing designs if not used within a 12 month period will incur a $10 set-up per colour.

All digitised embroidery files remain the property of ESP Apparel. A nominal charge towards the disc has been invoiced and calculated up to 4000 stitches for the exclusive use thereof. If at any time ownership/copy of this file is required, then the balance will be calculated at the industry standard charge of $10 per thousand stitches over and above the current invoiced amount.

Logo Colours

Embroidery: Colours are to be chosen by the customer from the thread options available – colours may not be able to be matched exactly as thread options are limited. The Customer is responsible for colour choice.

Screen-printing: All due care will be taken to ensure print colours match the colour swatch provided by the customer, however due to the colour and nature of various materials, it is often impossible to obtain a 100% match. All materials print differently and if your logo is being applied to more than one different style garment in the same order, variation in colour may occur.

Logo Position

Whilst every effort is made to place your logo in an exact position/angle every time various degrees of position are inevitable and a 3-5mm within exact position is considered acceptable.

Customers Own Garments

Whilst all care is taken, ESP Apparel is not responsible for any damage via embroidery or screen-printing to the customers own goods.

Products

Whilst every effort has been made to ensure accuracy of product and colours in our website they should be used as a guide only. ESP Apparel is not responsible for any colour variance.

Sizing

Whilst all efforts are made to advise in sizing, the customer is solely responsible for the size of the garments chosen, not Esp Apparel. Garments cannot be returned due to incorrect sizing. Esp Apparel is a wholesale company, not retail, therefore not all size’s are available for sampling. Garments cannot be ordered to simply ‘try on’.

Unders & Overs

While we endeavour to complete your order in full a 1-2% over supply or under supply is considered fulfilment on all orders.

Returns

ESP Apparel is a wholesale business, not retail, therefore garments cannot be returned due to customer’s change of mind. Garments are unable to be returned unless there is a manufacturing error.

Freight

Any freight costs are to be paid by the customer unless quoted otherwise prior to garments leaving ESP Apparel premises.

Payment Terms

ESP Apparel operates a NO ACCOUNT system. A 50% deposit is payable on all standard orders. A 75% deposit may be requested depending on the type of order placed. Once the deposit has been paid work will begin. The  balance is payable on completion of goods. Goods do not leave ESP Apparel premises unless payment has been received in full as cleared funds.
